dc.description.abstract	Την τελευταία δεκαετία ο διάλογος μεταξύ των ανώτατων και συνταγματικών δικαστηρίων αφενός και του ΔΕΕ αφετέρου, φαίνεται να ανανοηματοδοτεί τις θεμελιώδεις αρχές που χαρακτηρίζουν τη σχέση εθνικού Συντάγματος και δικαίου της Ευρωπαϊκής Ένωσης και κυρίως την αρχή της υπεροχής του δικαίου της Ευρωπαϊκής Ένωσης. Η παρούσα μελέτη πραγματεύεται το ζήτημα της σχέσης του εθνικού Συντάγματος και του δικαίου της Ευρωπαϊκής Ένωσης. Στο πρώτο μέρος, παρουσιάζεται η πάγια θέση του ΔΕΕ ως προς το ζήτημα και αναλύονται οι βασικές αρχές που διέπουν τις σχέσεις ευρωπαϊκού δικαίου και εθνικού δικαίου. Στη συνέχεια, μέσα από την επισκόπηση της σχετικής νομολογίας των ανώτατων και συνταγματικών δικαστηρίων των κρατών μελών, διερευνάται η στάση των κρατών-μελών ως προς το ζήτημα της σχέσης της εθνικής συνταγματικής έννομης τάξης και της ευρωπαϊκής έννομης τάξης. Επίσης, αναλύονται οι επιφυλάξεις που διατυπώθηκαν από τα εθνικά δικαστήρια ως προς την αρχή της υπεροχής του δικαίου της Ευρωπαϊκής Ένωσης. Τέλος, στο τρίτο μέρος της μελέτης, εξετάζονται οι θέσεις της ελληνικής θεωρίας και νομολογίας ως προς το ζήτημα. Επιπλέον, παρουσιάζονται τρείς περιπτώσεις όπου το ζήτημα της σχέσης εθνικού Συντάγματος και δικαίου της Ευρωπαϊκής Ένωσης απασχόλησε με έντονο τρόπο τα εθνικά δικαστήρια.	el

dc.description.abstracttranslated	In the last decade the dialogue between the supreme and constitutional courts on the one hand and the CJEU on the other, seems to redefine the fundamental principles that characterize the relationship between national Constitution and European Union law and above all the principle of the supremacy of European Union law. This paper studies the issue of the relationship between the national Constitution and European Union law. In the first section, it describes the consistent position of the CJEU on the issue and analyzes the main principles that govern the relationship between European law and national law. Then, through the overview of the relevant case-law, it explores the position of the member states on the issue of the relationship between national constitutional legal order and European legal order. It also analyzes the reservations made by the national courts regarding the principle of the supremacy of European Union law. Finally, in the third section of this paper, the positions of the theory and jurisprudence in Greece on the issue are examined. Furthermore, three cases where the issue of the relationship between the national Constitution and the European Union Law occupied intensively the national courts are presented.	el
